Know Your Rights

At Shaw Law Firm, we want you to know your rights. If you are questioned, or interrogated by the police, you should request an attorney. Even if you did nothing, and are innocent of the crime being investigated, you should have an attorney present to make sure your rights are protected.

DO NOT SPEAK WITH ANYONE WITHOUT CONSULTING AN ATTORNEY

Contrary to popular belief, innocent people do go to jail. Regardless of whether the police investigators act friendly or adversarial, they are out to solve a crime. If they believe you are a potential suspect, they will use their investigative police tactics to obtain incriminating evidence from you. Our experienced criminal defense attorneys can protect your rights and advise you regarding whether or not to answer questions.

Remember, anything you say can and will be used against you.

CRIMINAL PROCESS

Typically, you will be charged with a crime by a direct complaint or indictment. The next step will either be a preliminary hearing or an arraignment. In most cases, there will be other pretrial hearings to determine various issues, including evidentiary hearings, plea negotiations, and/or motion hearings. If your case is not resolved by a plea agreement, or through judicial relief, your case will be set for trial. In some cases, there may be an appeal after the trial.
